Democratic presidential nominee Joe Biden vowed that he would pass a bill making abortion rights legal nationwide if the Supreme Court overturns Roe v. Wade.
Biden was asked about his plans if President Donald Trump is able to get nominee Amy Coney Barrett confirmed to the Supreme Court.
"Number 1, we don't know exactly she would do. Although, the expectation is that she may very well overrule Roe," Biden said during an NBC News town hall. "The only response to that would be to pass legislation making Roe a law of the land. That's what I would do."
Trump fires false allegations:
Trump responded on Tuesday by attacking Biden with false claims.
“Joe Biden just took a more Liberal position on Roe v. Wade than Elizabeth Warren at her highest. He also wants to PACK our great United States Supreme Court. This is what the Dems will do. Remember as they try changing positions before elections end,” Trump tweeted, even though Biden’s position is not more liberal than Warren’s and he has not supported packing the Supreme Court.
“Biden and Democrats just clarified the fact that they are fully in favor of (very) LATE TERM ABORTION, right up until the time of birth, and beyond - which would be execution,” Trump claimed, even though Biden’s platform only supports such abortions if the mother’s safety is at risk.
Biden has not said whether he wants to pack the court:
Biden stayed mum on whether he would support expanding the Supreme Court if Barrett is confirmed during the first presidential debate last week.
“Whatever position I take in that, that'll become the issue,” Biden said. “The issue is the American people should speak. You’re voting now. Vote, and let your senators know how you feel.”
Some Democrats have suggested expanding the court but many key Democratic senators have said they would oppose such a move.
